JUDGE STRIKES DOWN BIDEN'S PAROLE IN PLACE PROGRAM

Updated: Nov 13

A Texas court determined that the Biden administration and the parole in place do not have sufficient authority to issue parole proceedings for certain spouses and their children who are in undocumented immigration status. At the moment, the decision is still pending a possible appeal, so those who planned to apply for the program are advised to wait until further notice.

The federal judge issued a statement suspending the Biden administration's program (Keeping Families Together), a program that provided relief of immigration status for more than half a million spouses and their family members in the country, which allowed them to apply for legal status without having to leave the United States.

New updated by USCIS published 11/13/2024 on uscis.gov:

Effective immediately, USCIS is taking the following steps to comply with the Court's Order:

·           Pending Form 1-131F applications will not be adjudicated and intake of new Form 1-131F applications will cease.

·           Anyone with a future Application Support Center appointment in support of a filed Form 1-131F should consider that appointment cancelled immediately.

·           External engagements on the KFT parole process are cancelled.

In the coming days, USCIS will publish additional information on how it will handle pending cases and paid application fees.

The federal judge's verdict not only dismantled the program but also the hopes of thousands of families who were eagerly awaiting the opportunity to remain together and achieve legal status with security and quality of life. The program would have allowed hundreds of non-citizen spouses and stepchildren to remain in the country after having contributed to the community, helping to grow the country's economy.
